A sale deed is a legal document that contains the details of the transfer of title, rights, and ownership of a property from a seller to a buyer.
An agreement for sale is an agreement to sale a property in the future. The agreement of sale specifies the terms and conditions, under which the property will be transferred. The Transfer of Property Act, 1882, which regulates the matters dealing with the sale and transfer of any property, defines the contract for sale or an agreement for sale as under:“A contract for the sale of immovable property is a contract that a sale of such property shall take place on the terms settled between the parties” –
Section 54: Section 54 further provides that “It does not, of itself, create any interest in or charge on such property.”
Under section 122 of the Transfer of Property Act, 1882, you can transfer immovable property through a gift deed. A sale deed, a gift deed contains details of the property, the transferrer and recipient. But instead of a sale consideration in a sale deed, a gift deed allows you to transfer ownership without any exchange of money. Registering a gift deed with the sub-registrar is mandatory as per section 17 of the Registration Act, 1908, and as per section 123 of the Transfer of Property Act. If you don’t do this, the transfer will be invalid.
A partition deed is executed to enable the property to be divided among the co-owners of the property such that each co-owner is allotted his share thereby making him the rightful owner of the share allotted to him. Partition deed ensures the legal division of the property which is jointly held by several people.
A release deed is a legal document that removes the claim of a person from immovable property and transfers his/her share to the co-owner.
A relinquishment deed is a legal document/instrument where a person legally or formally gives up or releases his legal rights of the said property being relinquished in the name of some other person. This is one of the modes of transferring rights of immovable property.
